What Are E2 Visas?

These are nonimmigrant visas which allow a foreign national to come to the U.S. To qualify, you must live in a country which has a treaty with the United States and invest in a new or existing company in the United States. Although the visa is temporary, you can seek an unlimited number of extensions if you continue to run the company in the U.S.

How Do EB-5 Visas Work?

This is an immigrant visa for foreign nationals to seek lawful permanent residence. You must invest a minimum of $1.8 million in a U.S. business, or $900,000 if you invest in an area that is rural or has high unemployment. The minimum amount changes regularly, so consult an attorney.

You must create a for-profit business in the area or invest in one. The business could be an LLC, sole proprietorship, or corporation. However, it can’t be a nonprofit, and you can’t simply buy a piece of real estate.

Your investment also must generate at least 10 full-time jobs. However, investors also have the option of investing in a regional center, which pools money from investors to fund projects, like resorts or shopping centers. This is an attractive option for those with the funds but not much experience or interest in developing a new business. Investing in a regional center also makes it easier to qualify with the necessary jobs created.

If you are granted a visa, you can immediately move to the U.S. and seek conditional residence for up to two years. After two years, you can seek permanent residence if your investment has created at least 10 full-time jobs.

  • If you obtain an EB-5, your spouse and unmarried minor children can also seek a green card.

  • Although you might invest in a rural area, you can live anywhere in the United States.
